Class Action Suit?
« on: January 28, 2008, 11:34:02 PM »

I hate to state the obvious, but it might actually be in our interest to look into filing a mass lawsuit against the hotel regarding car damages, breakins, losses and repairs?  I got the business card of the general manager.  I'm going to start talking with them about my situation (Dave, got robbed on Sunday), is anyone else interested in pursuing something like this?

Staff: were you informed that this was a high-risk area before the transfer was made?  Was any security measures discussed?

I think we might have something if we get access to the case load from the start of the year.  The cop who took my report informed me there've been somthing like 8,000 incidents since the start of the year...that's a lot considering January isn't even over.  I think this may be worth following up on.

I hate to say it but I doubt you've got a chance at this one.  As has already been pointed out hotels don't take responsibility for their parking lots.  I got a lift so I didn't see but I would be very suprised if their was not several clearly posted signs stating that.

At the pre-con meeting, they told us to make sure everyone knows not to leave valuables in their cars, but we all took that as a general warning - they did not tell us they were having a rash of break-ins.

Still, I doubt there is a chance for legal action :(

I called the manager of the hotel, they told me to shove it.  I don't know where else to go with this...recommendations?

Honestly?

I don't think you're going to get anywhere.  The hotel isn't going to accept any liability, and it's probably part of their room-rental agreement that they aren't responsible for lost or stolen possessions.

It sucks, but I don't think there's anything here that really, legally, is the hotel's responsibility.

Morally, we're ALL outraged that they are completely disinterested in protecting their guests more thoroughly.  :-(

A letter to the Hilton corporate offices, especially on a DE letterhead, might be worthwhile, telling them exactly why our stay was unpleasant, and why we don't ever want to use that particular facility again. Corporate types sometimes pay more attention to that stuff than the locals do. It won't help David or Dean, but some people *might* get their attitudes changed.

I'm highly surprised that the hotel's attitude towards us has changed so rapidly and vehemently...

oh, well.

Let me give you some advice from 4-5 years in the industry and a good two years in managment now.  Unless I'm wrong (and its certainly possible) Hilton is probably a franchise like Best Western is.  If thats the case  you're best bet is to try talking directly to the owner.  It may not make a major difference but it'd be  a start.  From their get together every one who had a problem of any kind with the hotel and all of you write Hilton Corporate.  The catch with sending a letter is that they'll really just refer it back to the hotel's managment (while we were still a Best Western I dealt with these all the time and I was only the Front Desk Manager not the GM or Owner) who will inevitably just send you a form letter basicly stating their very sorry but your sol.  The advantage though is that corporate will keep a copy of the letter and the response (at least BW always does I would assume its the same), they get enough of them and Corporate will take action and that will be a serious problem for the hotel.  This may not be the way Hilton handles these things but my guess is that its probably very similar.
